Components

Please select components carefully. Such as Memory, CPU's and Hard drives. We cannot return these products if incorrectly ordered due to the fragile nature of these products. We do advise checking www.kingston.com for memory configuration details. If in doubt please contact us to check before placing your orders.

ITD aims to provide the most up to date and accurate information available, however ITD reserves the right to make adjustments due to changing market conditions, product discontinuation, manufacturer price changes, errors in advertisements and other extenuating circumstances. ITD makes no warranties or representations as to the site's accuracy and assumes no liability or responsibility for any errors or omissions in site content.

Ecological Friendliness

We promote ecological friendliness by using products that are ecologically friendly. We will use recycled or recyclable packaging. We will always be mindful of environmental impact of e-waste and explore ways to minimize this.

Our prices are quoted inclusive of GST but exclusive of any applicable Freight Charges in NZ Dollars.

Damages or Loss in Transit

Claims for damage or loss in transit must be made within 48 hours. We cannot accept liability for goods damaged or lost in transit however details of any claim should be advised to us immediately and we will do all we can to rectify any situations that may arise. We do suggest paying the extra for a signature courier. Please contact us to organise this for you before placing your order.

Guarantees

Adequate response to malfunction is makes us the best. Our products are the best models reputable companies make. This is why problems are few. We totally support and uphold all Consumer Guaranties Act & associated Laws not only in letter but also in business ethics. Almost all products sold online ship with a 12 month warranty which is carried out by the manufacturer and is their responsibility.

Customers are entitled to purchase extended manufacturers warranties for a range of products. We cannot return these warranties once ordered and registered due to the nature of these products.

For all non-warranty issues, we will assist in contacting the manufacturer and/or service agents to get this replaced/repaired at the buyer's cost.

Insurance

ITD strongly recommends you fully insure your return shipment in the event of loss or damage and also recommend you use a carrier that can provide you with proof of delivery for your protection.

Risk of Loss

The seller retains ownership of all goods until the goods are paid for by the purchaser, at which time title passes to the purchaser. Any loss or damage that occurs during shipping by a carrier of ITD choosing is the responsibility of ITD to sort if there has been a signature courier request. Any loss or damage that occurs during shipping by a carrier of the Customer's choosing is the Customer's responsibility. Title to software will remain with the applicable licensor(s).

Shortages, Damages or Loss in Transit

Liability for shortages in the quantity of goods delivered is limited to making up the shortages. No claim for shortages in quantity will be allowed unless the customer gives notification of the shortage in writing within 7 days of the delivery and provides a reasonable opportunity for the seller to investigate the claim.
Goods leaving the seller's premises are adequately packed.

Claims for damage or loss in transit must be made against the carrier in the prescribed manner:

  • Prior to acknowledging delivery to the carrier the buyer must ensure that the complete consignment as per the carrier's note has been received.
  • Should there be a shortage or visible damage to outer packaging the carrier's note must be endorsed accordingly.
  • Within 7 days of receipt of consignment the buyer must ensure that all goods received are in good order and condition.
  • No claims will be considered after 7 days of receipt of goods. * While no liability for goods damaged or lost in transit will be accepted by the seller, details of any claim should be advised to the seller.

Seller's Liability and Maintenance Guarantee

The buyer shall ensure that the goods ordered are fit and suitable for the purpose for which they are required and the seller is under no liability if they are not.

The buyer is entitled to only such benefits as the seller may receive under any guarantee given to the seller by the manufacturer of the goods.

In lieu of any warranty, condition, or liability by law, the seller's liability in respect of any defect in or failure of the goods supplied, or for any loss, injury, or damage attributable thereto, is limited to making good the replacement or repair of defects arising under normal proper use and maintenance arising solely from faulty design, materials, or workmanship within the guarantee period, if stated, or otherwise within 12 months of the date of supply, provided always that such defective parts are promptly returned to the seller, unless otherwise arranged. At the termination of the appropriate period (ie guarantee period or 12 months as indicated above) all liability on the seller's part ceases.

The warranty does not cover damage from misuse, accident, negligent, inappropriate or improper operation, maintenance, installation, modification or adjustment.

The seller's liability under this contract and the warranty in this clause is confined to the buyer named in this contract, it being agreed that the seller has no liability to any purchaser of the goods from the buyer in that the buyer's rights under the contract are not assignable without the prior written consent of the seller.

The seller will not be liable for loss of profits or any indirect or consequential loss or loss, even if the possibility of such loss has been brought to its attention.

Website Terms

The seller's website and advertising only constitute an invitation to treat. Ordering goods (online or otherwise) constitutes an offer by the buyer to buy in accordance with these terms and conditions. The seller's acceptance occurs (and the contract is formed) when the goods are dispatched to the buyer.

ITD endeavors to provide current and accurate information on the Website. However, misprints, errors, inaccuracies, omissions (including incorrect specifications for products) or other errors may sometimes occur. ITD Ltd cannot guarantee that products and services advertised on the Website will be available when ordered or thereafter. ITD Ltd does not warrant that the content of the Website including, without limitation, product descriptions, price or photographs, is accurate or complete.

We respect your knowledge and judgement. Unless you ask for advice, we will assume you know what you want and ship the exact products you bought. If you are unsure of anything, we are more than happy to answer your questions about our products and choose the right products based on your needs and budget.

ITD Ltd reserves the right to: (a) correct any error, inaccuracy or omission at any time without prior notice or liability to you or any other person; (b) change at any time the products and services advertised or made available for sale on the Website, the prices, fees, charges and specifications of such products and services, any promotional offers and any other Website content without any notice or liability to you or any other person; (c) reject, correct, cancel or terminate any order, including accepted orders for any reason and (d) limit quantities available for sale or sold.

Stock

Our stock is updated a couple of times a day, but from time to time there can be errors due to incorrect stock take count's etc. Please note a online order which is showing stock at the time maybe incorrect, if this is the case we will contact you. It's highly unlikely, but worth mentioning.

If a product reads, "Please contact us" in the stock tab of our website, this means the product is currently out of stock and we will email you back with an ETA (Expected arrival Time) as soon as possible.

Please note mobile phone deliveries take one week.

Credit Card Payments

Please note all pricing on our wbsite reflects a 3% cash/online banking discount. If you require your products urgently and wish to pay via credit cards (Mastercard or Visa), please note that there is a 3% credit card payment surcharge. Please note credit card payments must be in the name of the order. If they do not match our payment gateway may refuse the order.

Website User Agreement

This is an Agreement between you and all persons you represent (and for purposes of this Agreement, "person" includes natural persons and any type of incorporated or unincorporated entity) and ITD Ltd regarding your access to and use of ITD Ltd website and all content, information, products and services available on or through the website (collectively, the "Website"). This Agreement also provides benefits to ITD Ltd affiliates, service providers, suppliers and other persons.

Each time you use the Website you signify your acceptance and agreement, and the acceptance and agreement of any person you purport to represent, to be bound by this Agreement as it then reads, and you represent and warrant that you have the legal authority to agree to and accept this Agreement on behalf of yourself and any person you purport to represent. If you do not agree with each provision of this Agreement, or you are not authorized to agree to and accept this Agreement on behalf of the person you purport to represent, you may not access or use the Website. This Agreement is in addition to any other agreement you may have with ITD Ltd, including a transaction agreement.

Warranties

Please note all product warranties are direct manufacturer warranties and subject to their terms and conditions. We recommend you check the warranty details for the products online or ask us if you are unsure. Best way to check for example: Nokia phone, check out www.Nokia.co.nz -> If there is no information please call us and we will find out for you. Please note some Microsoft Xbox products carry a warranty of 90 days. If in doubt please ask before purchasing. (www.microsoft.co.nz).

Returns & Refunds

Fairness is what our returns policy is designed around. Our returns policy is designed so as to discourage people from using products for a road trip, etc, then returning it. In the unlikely case of any problems, please get back to us and we will work with you to get a solution that works best for both you and us. Buyer's remorse (product works as it should, but buyer wants to return product because money is needed, etc) is accepted within 7 days of delivery minus 20% restocking fee. This is assuming no damage and everything is present apart from factory seal broken. Shipping costs are not refundable. Please contact us for a return address as different brands ship from different warehouses.

Please note products with damaged or no packaging cannot be returned, so please keep the packaging in the best condition you can.

Please note you must arrange a RMA (Return Number) before sending goods back. It becomes impossible to track goods without the proper paperwork and goods without RMA numbers will be rejected.

Goods supplied in accordance with the buyer's order can only be returned with the express approval of the seller.

Forward replacements are provided at the seller's discretion. If you have been provided a forward replacement and you do return the item it is replacing then the seller is entitled to charge the price of the forward replacement to your credit card.

Please select software and consumables carefully, such as ink cartridges, toners etc. We cannot return these products if incorrectly ordered due to the fragile nature of these products especially if packaging has been opened or seal broken.

If a product is found dead on arrival we can get it changed as long as we are notified asap and there hasn't been any water damage or physical damage. Also the manufacturers warranty on the product and exchange processes and procedures dictate the possible solutions. However any phones returned with water damaged will be billed to the customer.

Government Law & Dispute Resolution Consumer Guarantees Act: Your warranty is in addition to your rights under the Consumer Guarantees Act 1993. However, where you are purchasing for the purposes of a business, you agree that the terms of the Consumer Guarantees Act 1993 shall not apply. All warranties and conditions implied under any other statutes (including the Sale of Goods Act (1908) are expressly excluded from your warranty.

GST Increase - 1st October 2010 to 15%

There is a GST increase on 1st October 2010 to 15%. If for any reason, the GST amount has been calculated incorrectly for orders dated 1st October 2010 onwards, ITD will contact you, the purchaser, to replace an order online to ensure the correct GST component has been calculated.
